Welcome to Word Lab: Alchemist Learn (the "App"), a mobile application and website located at https://www.maumcrafted.com, provided by JU HONG PARK("we," "us," or "our"). These Terms of Use (the "Terms") constitute a legally binding agreement between you and us, governing your use of the App, including all its features, content, and services offered through both the mobile application and the website. By using the App, you agree to be bound by these Terms.

You must agree to these Terms to use the App. By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, forming a legally binding agreement between you and us. Your continued use of the App signifies your ongoing acceptance of these Terms. Word Lab: Alchemist Learn is a vocabulary learning application that provides access to a large vocabulary database with AI-generated definitions, examples, flashcards, quizzes, and personalized study plans. Users can enhance their vocabulary learning through various in-app features. Please be aware that the services offered through the App may be updated, changed, improved, suspended, or discontinued, either temporarily or permanently, at our sole discretion.

4. In-App Purchases and Subscriptions

Subscriptions: The App offers subscription plans, which may include a free trial period. Subscription plans provide ongoing access to premium features.

Payment Processing: All purchases and subscriptions are processed through the App Store or other relevant platforms and are subject to their terms and conditions. All aspects of in-app purchases and subscriptions, including payment terms, billing, cancellations, and refunds, are governed by the terms and conditions of the specific platform you are using.

Subscription Renewal: Subscription plans will automatically renew unless canceled by the user through the App Store or relevant platform. You are responsible for managing and canceling your subscriptions through the settings or interface of the relevant platform to avoid unintended renewals.

Changes to Fees: We may change our subscription fees. We will provide you with notice of any changes to subscription fees.

5. User Conduct

• Develop any third-party applications that interact with the App without our express written consent.

• Collect, harvest, or post anyone's personal information (including account names) from the App without their consent.

• Infringe upon or violate the intellectual property rights (including copyright, trademarks, patents, and trade secrets) of us or any third party.

• Use the App for any commercial purposes, including advertising or solicitation, without our express written consent.

• Attempt to circumvent any security measures or access controls implemented within the App.

• Post or transmit any content that is offensive, defamatory, libelous, obscene, pornographic, abusive, hateful, discriminatory, or otherwise inappropriate.

• Manipulate the App or its features in any way, including by using bots, scripts, or other automated means, to gain an unfair advantage or to disrupt the App's functionality (if applicable).

6. Intellectual Property

7. Disclaimers and Limitations of Liability

The App is provided "as is" and "as available" without any warranties. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, business interruption, or any damages resulting from your reliance on the App's content or functionality. We do not warrant that the App will be error-free, uninterrupted, secure, or free of viruses or other harmful components. 8. Termination

We reserve the right to terminate your access to the App at any time for any reason, including but not limited to violations of these Terms, engagement in illegal or unauthorized activities, or for any business-related reasons. Upon termination, your license to use the App will immediately cease, and we may delete any user data associated with your account, subject to the provisions of our Privacy Policy. You may also terminate your use of the App at any time by deleting the App from your device.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the following dispute resolution process :

Informal Negotiation: Both parties agree to first attempt to resolve any disputes informally through good-faith negotiation.

Mediation: If informal negotiation fails, the parties may agree to participate in mediation in the Commonwealth of Massachusetts, seeking assistance from a neutral third-party mediator to facilitate a mutually agreeable settlement.

Arbitration (Optional): As an alternative or in addition to litigation, the parties may agree to resolve any remaining disputes through binding arbitration in the Commonwealth of Massachusetts in accordance with the rules of the American Arbitration Association or another mutually agreed-upon arbitration service.

Jurisdiction and Venue: If the dispute is not resolved through negotiation, mediation, or arbitration, the courts of the Commonwealth of Massachusetts shall have exclusive jurisdiction and venue to resolve such disputes.

To the extent permitted by law, you waive your right to a jury trial and your right to participate in a class action lawsuit concerning any disputes related to these Terms.
